Introduction These Vendor Terms govern the use of MissCake Messaging (WhatsApp API Platform) by vendors (resellers, businesses, agencies). By registering as a vendor, you agree to comply with these Terms. 2. Vendor Role A vendor is authorized to: Use the platform for business messaging Manage their own clients or campaigns Send WhatsApp broadcasts and automated messages Vendors act as independent users, not employees or partners of MissCake Messaging. 3. Account Responsibility Vendors must provide accurate business details You are responsible for all activities under your account Sharing login credentials is discouraged Any misuse will be considered your responsibility 4. WhatsApp Compliance (Strict Policy) Vendors MUST follow WhatsApp Business Policy and messaging guidelines: Obtain explicit user consent (opt-in) before messaging Send only approved template messages where required Do not send spam, bulk unsolicited, or promotional abuse messages Avoid misleading, illegal, or harmful content ⚠️ Any violation may lead to: Number banning by WhatsApp Immediate suspension of vendor account No refund 5. Prohibited Activities Vendors are strictly prohibited from: Sending spam or unsolicited bulk messages Promoting illegal products/services Adult, gambling, phishing, or scam-related content Using fake identities or misleading campaigns Bypassing WhatsApp rules or system safeguards 6. Client Management (If Applicable) If you manage clients: You are fully responsible for your clients’ activities You must ensure your clients follow all policies Any violation by your clients will affect your vendor account 7. Payments & Wallet Usage Vendors must maintain sufficient balance before sending messages All payments are non-refundable Pricing may change anytime without prior notice No refunds for unused balance unless explicitly stated 8. Service Dependency Our platform depends on third-party services like Meta Platforms, Inc.. We are not responsible for: Message delivery failures Number bans or restrictions API downtime or policy changes 9. Account Suspension & Termination We reserve the right to suspend or terminate vendor accounts if: Any policy is violated Suspicious or abusive activity is detected Legal complaints are received ⚠️ In such cases: Access may be revoked immediately Balance will not be refunded 10. Data Responsibility Vendors are responsible for the data they upload You must ensure lawful data collection and usage You agree not to misuse customer data 11. Limitation of Liability MissCake Messaging shall not be liable for: Business loss, revenue loss, or damages WhatsApp number bans Campaign failures or delivery issues Use the platform at your own risk. 12. Branding & Reselling Vendors may resell services unless restricted Misrepresentation of MissCake Messaging is prohibited You must not claim official partnership without permission 13. Modifications to Terms We may update these Terms at any time. Continued use of the platform means acceptance of updated Terms. 14.
